Day 13A

Document contributions before the collaboration grows

A productive creative session can generate ideas faster than anyone can document them. Make time to record what happened before the project grows beyond that room.

Identify the participants and describe their actual contributions. Writing, performance, production, editing, administration and funding should be recorded accurately. A person's involvement does not automatically establish the same rights or payment entitlement as everyone else's.

Imagine a poet, musician and filmmaker developing a performance video. The team should discuss the poem, musical composition, recording, performances and film separately, then record how the finished project may be released.

Agree who can approve publication, negotiate opportunities and communicate with a distributor. Discuss credits, relevant ownership or licence arrangements, income calculations, reporting and payment. Have the necessary permissions and agreements checked for the work involved.

A split sheet can help record agreed shares for an identified work or income stream. It should be clear what those shares concern. A document about songwriting percentages may leave recording ownership and video permissions for separate agreements.

Keep dated drafts and session notes. Record the version each agreement concerns, circulate the final terms and give every relevant person a copy. If a contribution changes during production, update the record while the facts are still clear.

Build in a way to handle disagreement. Decide who will pause an unresolved release question, gather the records and arrange the appropriate conversation. A deadline becomes easier to manage when the team knows who is responsible.

Documentation gives collaborators a practical basis for working together over time. It can help the next publisher or administrator understand how the work reached its released form.

Today's action: make a contribution and approval record for one active collaboration.

Question: does everyone know which work, right or income stream their agreement covers?

Educational note: General South African IP education. Rights, permissions and remedies depend on the material, facts, agreement and applicable law. Obtain qualified advice for a significant transaction or dispute.

Day 12B

Paying for the work does not settle every right

A client pays an invoice and receives the finished artwork. Months later, the client asks another designer to turn it into a commercial template for resale.

The original creator objects. The client believes payment included unrestricted ownership; the creator understood the arrangement as a limited campaign commission.

Before deciding who is right, examine the work category, circumstances and complete agreement. South African ownership rules differ between situations. A receipt alone should not be treated as a complete explanation of every right, restriction or transfer.

The practical gap is visible even before that legal assessment. The parties never documented the later resale plan. They also did not distinguish the finished artwork from source files, supplier tools or third-party components.

The disagreement can delay the new product, require revised terms and strain a relationship that began with a successful delivery. Other contractors may already be waiting for instructions, while the client struggles to explain what it can authorise.

Preserve the brief, quotations, messages, invoice, delivered files and relevant terms. Seek a clear account of the intended arrangement and obtain qualified advice if ownership or a significant rights grant is disputed.

A written follow-up may help define future use, but do not rewrite the history or assume a later document automatically resolves every earlier issue. Agree any correction carefully and keep the records connected.

For the next commission, discuss ownership and intended uses before the price is accepted. Let the scope inform the offer, rather than discovering different expectations after production.

Today's action: review one completed commission for an unexplained ownership or reuse assumption.

Question: could both parties describe the same rights arrangement without relying on the words “I paid”?

Educational note: General South African IP education. Rights, permissions and remedies depend on the material, facts, agreement and applicable law. Obtain qualified advice for a significant transaction or dispute.

Day 13B

An undocumented collaboration can divide a release

The song has been delivered to a distributor when a collaborator asks why their contribution is missing from the credits and payment record.

Everyone remembers the session. They remember the agreement differently.

One person believes a fee settled the entire arrangement. Another recalls a promise of a share. A third thought the track could only be released after everyone approved the final version.

These are hypothetical facts, but the administrative problem is familiar: the project developed without a shared record that identified contributions, rights and decisions.

Investigate each issue separately. Establish what was created, what the relevant agreements say and which permissions were required. Do not infer automatic equal shares or sole ownership from who uploaded the track, paid the studio or appeared most prominently.

The immediate consequences may include corrected metadata, delayed distribution, payment reconciliation or a revised release plan. Partners can become uncertain about who can authorise the work. The collaborators may spend more time reconstructing messages than discussing the next project.

Keep session files, drafts and complete correspondence. Write a factual chronology and ask each person to identify the agreement and contribution they rely on. Significant ownership or payment disputes need qualified advice.

Avoid inventing a convenient split just to meet the launch date. Record an agreement only when the relevant people have actually reached it, and ensure it addresses the right work and income stream.

For future sessions, circulate a short contribution record promptly and resolve the commercial terms before release preparations become expensive.

Today's action: identify one collaboration whose credits, permissions or payment terms remain unresolved.

Question: if a contributor challenged tomorrow's release, could your records explain the agreed position?

Educational note: General South African IP education. Rights, permissions and remedies depend on the material, facts, agreement and applicable law. Obtain qualified advice for a significant transaction or dispute.

Day 14A

Check quotations translations and adaptations

A quotation, translation or adaptation brings an earlier work into a new setting. Begin by identifying the source and the kind of use you intend.

A short extract used to discuss a book raises different questions from reproducing a poem on merchandise or translating an entire chapter for a commercial publication. Describe the actual activity before deciding what permission or exception may apply.

South African quotation provisions have conditions, including fair practice, a justified extent and relevant acknowledgement requirements. A fixed word count should not replace that assessment. Other uses, including adaptation, need their own rights analysis.

Consider a publisher preparing an anthology with commentary. For every extract, the editor can record the source, purpose, extent and basis for inclusion. Where permission is needed, the request should explain the edition, formats, distribution and planned editorial treatment.

If a translator is involved, document that person's contribution and agreement too. Resolving the source work does not explain every right in newly contributed material.

Keep exact versions. Save the text supplied by the source, the extract or adaptation actually proposed, the permissions and the final approved wording. This makes it easier to check credits and understand any changes made during production.

Give editors a clear route for unresolved items. A placeholder in a working manuscript should remain visible until the question is settled. Track it through proofreading so that unverified material does not slip into the release file.

The aim is a publication whose creative choices and rights basis can both be explained. That supports responsible editing and gives contributors clearer expectations about how their work will appear.

Today's action: inspect one quotation, translation or adaptation planned for publication.

Question: can you explain the basis for that exact use without relying on an arbitrary word limit?

Educational note: General South African IP education. Rights, permissions and remedies depend on the material, facts, agreement and applicable law. Obtain qualified advice for a significant transaction or dispute.

Day 14B

A rewrite can still carry unresolved rights

A workshop team turns a published poem into a motivational handout. It changes several lines, removes the author's name and distributes the result under the programme's branding.

The team assumes the changes make the material its own. The original poem remains central to what has been distributed.

Changing wording does not, by itself, settle the underlying rights. Establish the source, the protected material involved and the basis for reproducing or adapting it. Attribution questions and the rights in any newly contributed work also need attention.

In this hypothetical example, copies have reached facilitators, participants and a partner's website. A correction may therefore require more than replacing one file. The team needs to locate distributed versions, decide what should happen to them and communicate accurately with the people using them.

Possible consequences include a complaint, reworking, interrupted delivery and a dispute about the use. A legal conclusion depends on the facts and applicable law; an accusation alone does not establish infringement.

Preserve the source and version history while investigating. Do not manufacture an earlier permission or suggest that minor wording changes prove independent creation. Where the work is important or a claim is made, obtain qualified advice.

For future materials, ask about source rights before the adaptation is commissioned. Let the editor see the relevant permissions or exception assessment. Keep the agreed author and translator credits attached through design and export.

When an original alternative is commissioned, ensure the brief calls for independent work and records the new contributor's terms.

Today's action: trace one rewritten third-party passage in your materials to its source.

Question: has editing been used as a substitute for checking whether the use is supported?

Educational note: General South African IP education. Rights, permissions and remedies depend on the material, facts, agreement and applicable law. Obtain qualified advice for a significant transaction or dispute.
