Its been a busy weekend, and on top of that, a landmark court decision that took affect thursday morning has caused quite a stir. Seems everyone from manufacturers to dealers and guntubers and activists and.... you get the idea, has had to rush to the interwebs to give their highly valuable opinions. I guess if I am going to be a cool guy in the "tactical" world, then Id better give mine. So here goes..
1. The default law of the land is the Constitution. When anything is in question or chaos, the US Constitution is my guide. This genius document clearly states that the right to keep and bear arms shall not be infringed.
2. The court ruled that in the case of the plaintiffs, the NFA registration process is unconstitutional. According to the 66 page document released by the court, this includes all past, current and future Gun Owners of America members. It also covers commerce activities of Palmetto state armory and Silencer Shop and its downstream commercial customers (dealers). This means for the aforementioned plaintiffs that there is no legal requirement for NFA registration for silencers and other NFA items.
3. The ATF had 10 days to respond. The lack of response is a willing refusal. Last thursday morning at 12:01 am The ATF's opportunity to appeal expired. Therefore removing restrictions of the NFA to the plaintiffs.
Here is the fun part. Many businesses are taking the safe route of waiting for ATF responses before commencing with non NFA transfers with the named plaintiffs. Understandably they are doing so out of caution as to not poke the bear of the bureaucracy. That is their right and their decision to make. God Bless them and I wish them success.
But I do not have the luxury of holding these decisions in reserve. I swore an oath the the constitution. I started this business with the intent to do my best to make the god given right of self defense as guaranteed by the constitution readily and financially available to all citizens and legal visitors. I must follow my oath and the constitution. So, I will be commencing transfers of silencers via 4473 process as I do not have any will to deny anyone the rights guaranteed to them.
Alot of people in this business have had alot to say about this.. but you know who hasnt said anything since the day of the judgement? The ATF and DOJ. It has stood in many a case law example that delays, hesitation and extended processing time of the government cannot impede or infringe upon the rights of citizens.
I will follow this with another post containing more details on the laws and procedures as it is a bit of a complex topic now.
