It was widely, almost universally, expected that Donald Trump’s 2025 executive order purporting to abolish “birthright citizenship” would not survive a U.S. Supreme Court review of its constitutionality. Not so expected was that four Supreme Court justices would claim Trump’s action *did* comply with the 14th Amendment despite its clear language that “all persons born or naturalized in the United States, and subject to its jurisdiction, are citizens of the United States.”

But this defeat for Trump isn’t as definitive as the one we expected, writes Ed Kilgore. “As a matter of constitutional law, Trump v. Barbara is a 5-4 decision that hardly closes off the question for all time. Rather than shutting down Trump’s efforts to radically redefine and restrict the meaning of citizenship, the narrow conservative majority at the Supreme Court will likely embolden him and like-minded nativists to keep up the fight.”

Former Transportation Secretary Pete Buttigieg, a high-profile Democratic Party figure and a potential 2028 presidential hopeful, said on Friday that authorities were called on his house over false allegations, in what he said seemed to be an effort to target him politically. It temporarily led to him being separated from his two children.
