UPDATE: we want to thank all of our friends, customers and the entire community for your support. The world needs a little more compassion and respect for all small businesses.
We decided to take the high road and not file a counter claim. Pennmark reached out to us yesterday to say that they feel as though going to court is a complete waste of time and money……. Well Duh! But they sued us, so I wasn’t quite sure how to respond. They asked how to resolve it. It’s easy, I’ll send the rent, you send the security deposit. Well… we sent the rent, they withdrew the case, but on their claim that they will “do a walkthrough “ and send ours back within 2 weeks. I don’t think they have any intention whatsoever of doing that, but I guess we will just wait and see!
THIS 👇👇👇 is why we have direct issue with Justin Bartholomew and PennMark. We have tried to go out peacefully and with our head held high but this is the last straw!! In 6 years we were never 1 day late paying our rent. Our last rent was due on June 15th 2022 along with our electric bill. I sent a check in for the electric bill along with a letter nicely stating that we will not be sending in an additional check for rent because we paid a security deposit. We stated in the letter that in lieu of us sending a check then waiting for reimbursement of the SAME EXACT amount, we would just call it a wash. The “reason” we were given for our June 30th eviction was that our space was to be demolished. If our space is being DEMOLISHED than there is no reason to have to schedule a walkthrough to receive our security deposit back. I thought this was accepted and all was good till we opened our mail today. NO CALLS, NO EMAILS, no nothing just a summons to COURT!!!! We are being sued for one month rent PLUS $2500 in attorneys fees!!! PennMark is the attorney!!!! Even if they believe they are owed this, it was literally written only 1 day after it would have been due! Seriously who does this!!!!!! THIS is why the mall died, not the tenants!
I guess I’ll update on the 12th when we have to take a day off of our full time jobs to go to court. We are a small husband and wife owned business. Used our savings to open, poured our heart and souls into it, and this is what happens!! PennMark: haven’t you put us through enough!!!!!
