Last Saturday January 20th, a Sheriff’s deputy ordered RJ and I to turn ourselves in to be charged with 2 misdemeanors each. One involves a photo of our stalker, who exposed his ge****ls and urinated onto our property in front of me.
This photo went to our lawyer who showed it to the Asst DA who showed it to the judge. The judge advised that probation be made aware of another violation of the OOP. The DA and the Sheriff declined to arrest and/or prosecute. The charge against us now is that disseminating this photo was done with intent to cause grievous emotional harm to our stalker. That’s rich.
The other charge we are facing is that 2 of our security cameras are pointed into our stalker’s bedroom and bathroom. One of the cameras has been busted by weather and obviously dead for over five years. We had discussed this in court several years ago.
The other camera in question is pointed straight down our building watching our alleyway camera beneath it. Why? Because last summer the alley camera and its mount were smashed off the 2nd floor of our home, and the only way to prevent a redo is to have a camera on the camera. This overhead camera also caught our stalker shoveling cat food and dirty litter under our home with his bare hands. Several months ago when the sheriff viewed this security clip , he arrested Joe on a felony contempt in the 1st charge, one of three felonies he has been charged with since his release from county jail. This is the camera our stalker wants removed .
The deputy who took Joe’s complaint and arrested us said she had no prior knowledge of the case, the 8 years of constant harassment we have undergone. Nor the order of protection we have had since 2018 that extends to 2030. Nor was she aware that our stalker and his son were given injunctions in civil court for the easement -they are only permitted to pass without delay between the two houses.
When presented with more violations of the Order of Protection (OOP)and the easement, the DA declined to pursue.
For the three felony arrests , each with a recommended jail sentence of 1-4years , the ADA offered Joe a plea deal of thirty days total, asserting that these felony violations are trivial.
After 8 years of harassment, with our stalker pleading guilty in civil and criminal court to homophobic harassment and stalking, the DA and police have now arrested the victims. Please Let DA Brian Conaty how this reeks. Call his office at 845- 794-3344 and email him at [email protected]
