Ran across this, thought you should know.

Texas Sales Tax: Whether you sell art through a gallery or out of your own studio, Texas considers fine art "tangible personal property" and it is subject to state and local sales tax. If you are selling directly, you may need a Texas Sales and Use Tax Permit. If you sell through a gallery, the gallery usually handles collecting and remitting this sales tax.

Opinion definition:

What are the two types of old art galleries, and one new type.

The two primary types of galleries are Vanity Galleries (which charge artists money to exhibit and sell their work up front and a Traditional/Commercial (which do not charge fees to exhibit an artist's works unless sells are made.

There is also a new category commonly referred to as Public Supported Galleries which by their mandate from the state require them to operate as a traditional commercial gallery ( and a 501) which does not bill for the services up front and gives the artist opportunity to make sales directly between the artist and the patron.

Which type of gallery do you like, do you think my definitions are correct, if you don't please chime in and try to change my mind.

Why do art shows require artists to do 51% or more of the Work.

Good Art Shows and Festivals require artists to do at least 51% (sometimes up to 80%) of the work to maintain authenticity, preserve the integrity of a "handmade by the artist selling the art" at the event, and prevent artists from acting as mass-market retailers or retailers in general.

So what do you think are we on the right track if you disagree reply and try to change my mind.

Opinion definition:

An Arts and Crafts market (or Craft Fair) is an event where local and regional creators sell handmade goods (51% or more work done by the artist) directly to the public. Offerings typically include fine art, ( 2 and 3D), pottery, jewelry, metal, textiles, woodwork, and custom decor and accessories. These markets focus on original craftsmanship rather than mass-produced items. And no retail or kit items.

So what do you think, are we on the right track if you disagree let me know maybe you can change my mind.

Opinion definition:

What is a pop-up store/shop, we believe it is a temporary Retail space that opens for a limited period—ranging from a few hours to a few months. It allows brands to sell manufactured products, test new markets, or create buzz without committing to a long-term lease. Items sold can be either mass produced commercial products and or services and possibly craft type or handmade items.

What is a Makers Market. Is it a curated, or organized community-focused event where independent artists, artisans, and small business owners sell only handmade goods they themselves made directly to the public. It acts as a vibrant alternative to traditional retail, emphasizing craftsmanship, and unique, one-of-a-kind products.
