Have you seen herons, egrets, or other migratory birds in your neighborhood? While these birds can sometimes create noise, odor, and mess near homes and businesses, they are protected under the Migratory Bird Treaty Act of 1918 and cannot be disturbed or moved during active nesting season (typically March–October). A rookery forms when large numbers of egrets or herons nest together in one concentrated area. It’s important to try to prevent a rookery from establishing, because once it does, there is very little that can be done until the next nesting season.
What can you do before nesting begins?
Familiarize yourself with the variety of migratory birds and read our prevention tips by visiting our website, hursttx.gov/migratorybirds.
What can you do once birds arrive?
Use a combination of scaring devices, such as noisemakers, bright night lights, or water sprays, before migratory birds lay eggs. DO NOT harm or move the birds or eggs. The international treaty prohibits harming birds or eggs. Once nesting birds produce eggs, all scare tactics must cease.

If you see any migratory birds in your neighborhood, please report these sightings using our online form at hursttx.gov/migratorybirds or by calling the Parks Department at 817-788-7325. Please continue routine property maintenance and contact Hurst Animal Services by calling 817-788-7216 if you see injured birds or fallen eggs.
