In 2008, gay/le***an marriage was voted as legal, by the California Supreme Court. However in November 2008, citizens of California passed Proposition 8, again making gay marriage illegal in California.
“8” is a dramatized reenactment of the subsequent lawsuit filed by four gay/le***an plaintiffs against California in the federal trial titled “Perry v. Schwarzenegger” (California's then-governor).
This federal trial, overturned California's Proposition 8 ban on gay/le***an marriage - ruling it in violation of the due process and equal protection clauses of the 14th amendment of the US Constitution - and thus constitutional.
Bring your straight friends who may be on the fence about gay/le***an marriage. The play will help them understand why a US federal district court judge, and subsequently the US federal ninth district court of appeals, both voted to overturn Proposition 8, making gay/le***an marriage once-again legal in California.
Although not portrayed in the play, this same case was recently appealed to the US Supreme Court on March 26th 2013, now titled “Hollingsworth v. Perry”. And a ruling is expected to be announced by the end of June 2013.
