Andy Warhol’s images of Prince ruled NOT Fair Use by the Appeals Court as they were deemed substantially similar to the Goldsmith Photograph. The Second Circuit’s opinion focused on the distinction between infringing derivative works and transformative works encouraged by the fair use doctrine. The Court held that “the secondary work’s transformative purpose and character must, at a bare minimum, comprise something more than the imposition of another artist’s style on the primary work.”
