Justice James Omotosho of the Federal High Court in Abuja has discharged and acquitted suspended Deputy Commissioner of Police, Abba Kyari, of a 23-count charge bordering on alleged non-declaration of assets filed by the NDLEA.
Kyari was charged alongside his two brothers, who were accused of swearing to false affidavits to conceal the origin of certain properties.
In his judgment, Justice Omotosho ruled that the NDLEA failed to provide sufficient evidence to prove its allegations against the defendants, particularly on the issue of ownership and non-declaration of landed properties.
The court explained that ownership of landed property can be proven through traditional history, title documents, acts of possession, or possession connected to the owner. However, none of these were presented by the prosecution.
The judge noted that the NDLEA did not provide documents linking Abba Kyari to properties located at Fountain Estate, Kasana, which were said to belong to Ramatu Kyari.
Similarly, the prosecution failed to present evidence connecting him to other properties allegedly located on Linda Choko Road in Asokoro, Abuja, and in Maiduguri, Borno State.
In his defence, Kyari maintained that the Maiduguri properties belonged to his late father and were left for him and his siblings. According to the court, the prosecution failed to prove otherwise.
Justice Omotosho also held that the charges against Kyari’s brothers for alleged conspiracy were not proven and appeared to have been filed in bad faith.
Consequently, the court discharged and acquitted all the defendants.
