Two prominent legal practitioners have criticised the Malawi Police Service for taking six suspects in the murder of Kamuzu University of Health Sciences lecturer and Queen Elizabeth Central Hospital doctor, Dr Victoria Bobe, to the scene of the crime in Blantyre, describing the move as unprofessional and potentially prejudicial.

During the visit earlier today, the suspects narrated how they allegedly committed the crime at the deceased's house in Chigumula.

But lawyer Sylvester Ayuba James through his page said the exercise amounted to โ€œtheatricsโ€ rather than a proper investigation, warning that such actions undermine the presumption of innocence guaranteed to suspects before trial.

He argued that investigators appeared to be seeking public validation instead of focusing on legal standards required in court.

James stressed that questioning police conduct does not amount to condoning the murder, noting that while Dr Bobeโ€™s death was tragic, investigative institutions must act with care and restraint.

Another lawyer, Khumbo Soko, echoed similar concerns, stating that investigators should not โ€œplay to the galleryโ€ but focus on presenting a strong case before the courts.

He said police work must be done quietly and professionally to avoid creating loopholes that defence lawyers could exploit.

Soko warned that courts are guided by evidence and procedure, not public emotion, and that poorly handled investigations risk cases being dismissed.

The six suspects remain in custody as investigations into Dr Bobeโ€™s murder continue to bring to book two more individuals.

In a move hailed as a testament to leadership and a commitment to unity, Honourable Chikondi Luv-christ Chisale , the Member of Parliament for Kasungu Central, has announced the withdrawal of a case involving him and the State Second Vice President, Honourable Enoch Kamzingeni Chihana who is also the leader of Alliance for Democracy(AFORD).

The case stemmed from incidents during the recent campaign period, including the damaging of Honourable Chisaleโ€™s vehicle and the alleged theft of funds and campaign materials.

Renowned lawyer Khumbo Bonzoe Soko writes:

Investigators must not play to the gallery, they must play to the Judge. He or she is the only one who matters. They must aim to compile a solid docket which closes obvious gaps that defence counsel exploit. In fact, they must work in silence. In the dark literally. Their vindication comes in court.

Otherwise, courts don't traffic in emotions. If an investigation is bungled, cases get dismissed.

It is that simple.
