In the realm of U.S. copyright law, protection extends to original creative expressions, but it can be complex when applied to AI-generated content. When a person adds their creative input to something that may not be inherently protected, such as a raw AI-generated image or a computer-generated musical riff, their added expressions are granted copyright protection.
For instance, when an artist edits, composites, or draws over a raw AI-generated image, they introduce their unique creative touch into the work. This added layer of creativity, which is the result of human decision and skill, is considered an original expression and is eligible for copyright protection.
Likewise, in the case of a musician who incorporates an AI-generated riff into a song, the surrounding musical elements, lyrics, and arrangement represent the musician’s original contributions and are protected under copyright law.
It’s important to note that the application of copyright law to AI-generated images is an evolving and unsettled area. Current and future court cases, as well as potential legislative changes, may influence the extent of copyright protection for AI-generated works.
Therefore, it’s not advisable to presume that you have unrestricted freedom to utilize AI-generated content without considering potential copyright-protected expressions. Moreover, the legal landscape is dynamic, and future changes may enhance the protection of such works.
