The judge held that the January policy violated the Immigration and Nationality Act by displacing consular officers from the role Congress gave them: evaluating applicants individually under criteria established by law. The State Department had justified the suspension by claiming that nationals of the designated countries faced an elevated risk of becoming dependent on public assistance.

The suspension extended across parts of Africa, Latin America, the Caribbean, the Balkans, South Asia and the Middle East.

Judge Vargas's ruling sent applications back for further consideration, as she characterized the Trump admin policy as “Orwellian logic.”

Experts told the newspaper that nationals of the listed countries receive roughly 40 to 45 percent of all immigrant visas.

This is a huge win for immigrants and their rights to entire America while abiding my the law.
