🚨 Should foreign criminals be deported immediately? 🇬🇧
The UK already has powers to deport foreign nationals convicted of crimes. Under current law, a deportation order is generally mandatory for a non-British or non-Irish citizen sentenced to at least 12 months’ imprisonment, subject to legal exceptions. Since March 2026, this also covers qualifying suspended sentences of 12 months or more.
The latest Home Office figures show 5,962 foreign national offenders were returned from the UK in the year ending June 2026 — the highest level recorded since 2017 and a 12% increase on the previous year.
At the same time, 21,294 foreign national offenders subject to deportation were being monitored in the community at the end of June 2026.
The debate is now about how quickly deportations should happen while still respecting appeals, human-rights obligations and other legal safeguards.
